Life sentence follows Bexar County capital murder conviction

A Bexar County jury has convicted 47-year-old Frank Deleon Falcon of capital murder in the July 14, 2022 shooting death of his mother, Linda Webster, at a home in the 300 block of Gillette Boulevard on San Antonio’s South Side. Under Texas law, the conviction resulted in an automatic sentence of life in prison without the possibility of parole.

The same incident left Falcon’s stepfather, Mark Webster, with a gunshot wound to the head. Mark Webster survived after being taken to a hospital for treatment. A child was also inside the home at the time of the shooting, and authorities said the child was not physically harmed.

What prosecutors alleged, and what jurors heard

Investigators were dispatched to the residence around 2 a.m. on the day of the shooting. During the trial, jurors were shown police body-worn camera footage and heard testimony from responding officers and other witnesses.

Prosecutors argued that a family dispute tied to Falcon’s living arrangement and a planned eviction set the stage for the violence. In court, prosecutors contended that Falcon had been allowed to live at the property under an agreement connected to payment of property taxes, and that the Websters were moving to evict him after taxes went unpaid.

Evidence presented at trial included testimony that Mark Webster identified Falcon as the shooter in statements captured on body camera video. The case also included testimony about Falcon’s movements after the shooting and his arrest.
